Currently, there are 30 highly qualified, diverse judicial nominees – including 19 district court nominees and 7 circuit court nominees – who have been waiting for a vote in the Senate for far too long. Among the nominees are women, minority, and LGBT nominees that would bring much-needed diversity to the federal judiciary.
Now what?
Progress has been made on district court nominees, but the Senate must also act on the circuit court nominees. It must bring these nominees to the floor for consideration by the full Senate in a timely manner. There is nothing left to do except vote.
So, why do “our courtrooms stand empty”?
Throughout the president’s first term, a small minority in the Senate has waged a persistent campaign of obstruction to slow down the confirmation process and even deny confirmation votes to highly qualified nominees. This has resulted in a judicial vacancy crisis, with more than 100 vacancies nationwide – including 29 deemed judicial emergencies where there aren’t enough judges to handle the caseload.
