MCKENNON v. NASHVILLE BANNER PUBLISHING CO.

The Supreme Court ruled unanimously that an employer cannot use so-called "after-acquired evidence" to avoid liability for discrimination. The question before the Court was "whether an employee who was discharged in violation of the Age Di scrimination in Employment Act of 1967 (ADEA) is barred from all relief when, after her discharge, the employer discovers evidence of wrongdoing that, in any event, would have led to the employee's termination on lawful and legitimate grounds."
